Terms of Service

1. Acceptance of Terms

By accessing or using ToneShift AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

ToneShift AI is an AI-powered text style transformation service. We use third-party AI models (Anthropic's Claude) to process and transform your text into various styles. Transformed text is stored for your convenience and may be shared via public links if you choose.

3. Account

You must be at least 13 years of age to use the Service. You may create an account using email/password registration. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

Plans — Free ($0), Creator ($9.80/month), and Pro ($19.80/month).
Billing — Paid plans are billed monthly and automatically renewed via Stripe.
Cancellation — You can cancel your subscription at any time from the Settings page. After cancellation, you will retain access to your paid plan features until the end of the current billing period.
Refunds — Refund requests are handled on a case-by-case basis. For full details, see our Refund Policy.
Usage limits — Feature availability and usage limits vary by plan as described on our Pricing page.

5. Acceptable Use

You agree not to use the Service to:

Generate or distribute harmful, threatening, abusive, defamatory, or illegal content.
Attempt to abuse, overload, or disrupt the API or infrastructure.
Reverse-engineer, decompile, or disassemble any part of the Service.
Use automated means (bots, scrapers) to access the Service without our prior written consent.
Impersonate another person or entity, or misrepresent your affiliation.

6. Intellectual Property

Your content — You retain all rights to the text you input and the transformed output generated by the Service.
Our service — ToneShift AI, its UI, branding, style presets, and underlying technology are owned by us and protected by intellectual property laws.
License grant — By submitting text, you grant us a limited, non-exclusive license to process your text solely for the purpose of providing the Service.
Public sharing license — When you choose to share a transformation via a public link, you grant us a non-exclusive, worldwide license to display and distribute that content through the Service, including in preview images for social media sharing.

7. AI Output Disclaimer

AI-generated transformations are provided for convenience and may not always be accurate, appropriate, or error-free. You are solely responsible for reviewing and verifying all output before use. The Service does not provide legal, medical, financial, or professional advice. Use AI-generated content at your own risk and judgment.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless ToneShift AI and its operator from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your violation of these Terms, your use of the Service, or your violation of any rights of a third party.

12. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, the Service, or third parties. Upon termination, your right to use the Service will immediately cease. You may request data deletion by contacting us. If you delete your account voluntarily, all associated data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

14. Force Majeure

Neither party shall be liable for any failure or delay resulting from events beyond their reasonable control, including natural disasters, internet or third-party service outages, or power failures.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance by email or by posting a notice on the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
